The United Sections of the Court of Cassation have declared the existence of Italian jurisdiction in a dispute concerning derivatives governed by the ISDA, when the contracting party asserts a title that has a jurisdictional connection with the Italian legal system.

In July 2026, however, the Constitutional Court revoked the right to Court of Justice of the European Union the question of whether such limitations are compatible with Articles 9 TEU and 20 TFEU, in particular when they affect persons born abroad before the entry into force of the new legislation.
